User Agreement (Terms of Service)

1. ACCEPTANCE OF TERMS

By downloading, accessing, or using the "Eiyoo" mobile application (the "App"), provided by Eiyoo Team ("we," "us," or "our"), you agree to be bound by this User Agreement ("Agreement"). If you do not agree, do not use the App.

2. ELIGIBILITY

You must be at least 17 years old to use this App. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into this Agreement.

3. ACCOUNT REGISTRATION

To access certain features, you must register an account providing accurate information (Name, Username, Email). You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. LICENSE AND INTELLECTUAL PROPERTY

4.1 License Grant
Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App for your personal, non-commercial use.

4.2 Ownership
The App, including its code, design, and AI technology, is owned by Eiyoo Team and protected by copyright and intellectual property laws.

4.3 User-Generated Content (AI Images)

Ownership: You retain ownership of the text prompts you input and the images generated by the App ("User Content"), subject to applicable laws.
License to Us: You grant us a non-exclusive, worldwide, royalty-free license to host, process, and display your User Content solely for the purpose of providing the Service to you (e.g., generating the image and displaying it on your screen).

5. PROHIBITED CONDUCT AND AI USAGE POLICY

Zero Tolerance Policy: You agree NOT to use the App to:

Generate images that are illegal, harmful, threatening, abusive, harassment, defamatory, vulgar, obscene, or invasive of another's privacy.
Generate child sexual abuse material (CSAM) or content promoting violence or self-harm.
Infringe upon the intellectual property rights of others.
Reverse engineer, decompile, or attempt to extract the source code of the App.
Use the App for any fraudulent or malicious purpose.

Violation of these rules will result in immediate termination of your account.

6. SUBSCRIPTIONS AND PAYMENTS (If Applicable)

If the App offers subscription services, payments will be charged to your iTunes Account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage subscriptions in your Account Settings.

7. PRIVACY

Your use of the App is also governed by our Privacy Policy, which is incorporated by reference into this Agreement.

8. DISCLAIMER OF WARRANTIES

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We do not guarantee that the AI-generated images will be accurate, unique, or suitable for your specific needs. The AI generation process may occasionally produce offensive or incorrect results; such results do not represent the views of Eiyoo Team.

9. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Eiyoo Team shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the App.

10. TERMINATION

We reserve the right to suspend or terminate your access to the App at our sole discretion, without notice, for conduct that we believe violates this Agreement or is harmful to other users, us, or third parties.

11. GOVERNING LAW AND DISPUTE RESOLUTION

11.1 Governing Law
This Agreement shall be governed by the laws of the jurisdiction of our principal place of business, without regard to its conflict of law provisions.

11.2 Binding Arbitration
Any dispute arising from or relating to this Agreement shall be settled by binding arbitration in accordance with the rules of the arbitration body in our jurisdiction. You waive any right to a jury trial or to participate in a class action.

12. APPLE-SPECIFIC TERMS

Acknowledgment: This Agreement is between you and Eiyoo Team only, not Apple. Apple is not responsible for the App or its content.
Maintenance: Apple has no obligation to furnish any maintenance and support services with respect to the App.
Warranty: In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever.
Third-Party Terms: You must comply with applicable third-party terms of agreement when using the App.
Third-Party Beneficiary: Apple and its subsidiaries are third-party beneficiaries of this Agreement.
